The commercial licence is to get a copy under a different (non-GPL) licence, which is primarily to escape the redistribution term of the GPL, the question is does this term apply to their use of the software.
Commercial in this sense is the name of the licence, not to the use you put the software. RMS no doubt would have called the other licence a "proprietary licence" for clarity.
