Current contract law allows the terms of a contract to be pretty
arbitrary. There is, I think, a growing need for regulation at a
legislature level as to just what certain types of contract can and
cannot stipulate. Unfortunately I don't wait in hope that a more
sensible contract law will be dreamt up anytime soon. (I'd advocate a
few classes of contract defined in law, and these classes effectively
having detailed whitelists as to what terms are permitted, rather than
having a few 'unfair contract' laws that blacklist a few dodgy practices
and trying to keep up with legalese speaking crooks.)
