That's fair comment but the advertisers know it is human nature to grasp the number quoted - the headline - and subconsciously ignore the 'up to'. I do think more should be done by the companies in the advertising to highlight that it is dependent on local conditions - even if they just mention it at the end of the advert. I don't think the vendors are miss-selling in that sense - the products offered can connect at the higher speeds and they all state that it is the best speed attainable.
