When you install 10.04 it will ask if you want to erase teh entire disk
and insatll it, or if you want to install to the remaining empty space,
a third option is custom partitioning, I can't recall its exact wording,
this is the one you want to choose.

You will then get something looking a lot like gparted, select where
your existing /home partition is by clicking it, then in the drop down
list to the lower right (going off memory) choose /home

You DO NOT want to format it, by default the checkbox won''t be selected
to format so leave it alone, I am mentioning it so you can double check,
as I'm going off memory again.

Then you can just click on the partition you want / to be, and choose /
from the drop down, you may want to format this, perhaps to ext4 or
something.

If (and it should be) the second HD you are adding is visible you can
also elect to partition it, format it, and decided where to mount it,
perhaps /mnt/data/ then you can always symlink as you suggest from ~/

Hope that helps, if in doubt, backup your /home to the spare 40gb for
the moment, then if it all goes pear shaped you have your back up, when
its up and running you can unke that 40gb and set it up after,
personally though I would have no fear in doing it the way I described,
my most important photo's and documents are backed up, everything else
doesn't matter so much and is merely bandwidth/time to replace.
