I think the piece is pretty accurate, and pretty useless at explaining
itself.

I'd probably file it under "FUD".

I mean why would you get a lawyer in. If I wanted to know about a
software issue I'd ask software people. Sure IP lawyers are great if a
dispute arises, but you don't ask a lawyer when you want to ensure you
wiring meets regulations, you ask an electrician.

But then if you tried to explain proprietary software by studying the
terms of the EULAs, you'd probably find it a pretty difficult task...
