I would imagine this would make it easier to provide indemnity to
Novell customers - microsoft won't be able to sue them or novell for
patent infringement. If Redhat cosy up to IBM, they can probably
leverage some defense against software patents too.

They won't be able to actively use any patents, and it would be very
hard to anyway - has anybody ever seen a useful software patent, ever
- I don't think anybody (with a modicum of sense) has ever paid money
to license software patent without there being the threat of
litigation for infringement.
