This will create a lot of problems for Novell: anything they create that is covered by one of Microsoft's patents cannot be licensed under the GPL (since it requires that any patent license required for the code to be licensed to everyone). And if the code isn't GPL, how can they incorporate it into SuSE which is under the GPL? This is probably the beginning of the end for Novell - Microsoft is the only winner here.
